By accessing and using this Site, you declare and warrant that you are at least 18 years old (or have full legal capacity) and that you are legally entitled to place orders or use the services made available.

The entire content of the www.marlyd.ro website — including, but not limited to: texts, product/service descriptions, images, videos, photographs, graphic elements, logos, registered trademarks, databases, software, design, style, structure and source code — is the exclusive property of SC MARLYD MEDICAL DEVICES SRL and is protected by Romanian and international copyright and related rights legislation (Law no. 8/1996).)
The MARLYD® trademark is registered with the State Office for Inventions and Trademarks; it is protected by law, any form of misappropriation is subject to legal action, and its use by any entity other than Marlyd Medical Devices SRL is considered an offence.
Marlyd reserves the right to change, supplement or replace the information on this website – products, product descriptions, prices, etc. – in part or in full, at any time and without prior notice.

Consequently, any unauthorised use of the Site’s content constitutes a breach of the law and entitles our company to seek compensation for the damage caused and to hold those responsible liable under civil, administrative or criminal law, in accordance with the legislation in force.
Commercial terms
- The prices published on this website are expressed in RON/lei and do not include VAT. The total order value, including the statutory VAT of 21 % and the shipping cost, is shown in the shopping cart before you complete the order.
- Prices are valid at the time of publication; however, adjustments are not excluded and may be made without prior notice whenever necessary during the year.
- Minimum order: for us to process your order, it must have a minimum value of 100 RON (one hundred lei) excluding VAT.
- Prices do not include delivery costs, unless otherwise stated.
- Free shipping: the minimum standard order to qualify for free shipping is 300 RON/lei excluding VAT. For orders below this threshold, a flat shipping fee of 25 RON is added automatically (price including VAT).
- Payment term and method: payment is made either cash on delivery when you receive the parcel, or in advance by bank payment order after the online order has been confirmed.
- Notification of product defects. Any complaint about a defective product must be sent to Marlyd in writing within 2 days / 48 hours of receiving the product, or as soon as the defect is detected. Later complaints will NOT be considered.
- Marlyd Medical Devices SRL is NOT responsible for incorrect storage or handling of the products.
- For firm orders from customers, Marlyd Medical Devices SRL may request various amounts as an advance payment for products that are not in the company’s stock. If the customer refuses to purchase the product upon delivery, the amount paid will be forfeited.
- Our service includes administrative and commercial communications, which will be sent to you once you decide to register as a user.
Products and prices
The technical specifications, presentation images and/or prices of the products on this website are for information purposes only and may be changed without prior notice (unless you submit an online order and the order is confirmed by phone with a representative of the Company.)
Marlyd does not guarantee that the product descriptions or any other content on the website are
free of errors.
The images shown on the website are for information purposes only; the products actually delivered may differ from them only in terms of colour, appearance, design, etc., which will be established when the seller confirms the order.
Marlyd also does not guarantee the stock availability of the products displayed; therefore, the company is entitled not to deliver a given order in part or in full if certain products no longer appear in the supplier’s current offer or are unavailable for other reasons (temporarily out of stock, sold out, etc.).
If payment is made in advance, the customer will be entitled to a refund of the money paid for that product. In all cases where products cannot be delivered, the customer may only request the immediate refund of the amounts already collected by Marlyd, and NOT any other compensation.

Every order received through www.marlyd.ro will be checked and confirmed by phone with the
customer.
All products sold are covered by the legal guarantee of conformity under the legislation in force (Law no. 449/2003 / Government Emergency Ordinance (OUG) no. 140/2021). If any lack of conformity or manufacturing defect is discovered, the buyer is entitled to request repair, replacement or a refund of the product’s value.
Purchasing products
To purchase products from this online store, you must meet the conditions mentioned above and fill in the online order form on the Site, or you can call a Marlyd representative on the phone numbers displayed, during the hours indicated on the website.
When you place an online order, a Marlyd representative will contact you to establish: product stock availability, delivery terms, methods and times, payment methods, information on product warranty periods, etc.
ORDERS PLACED ONLINE ARE SHIPPED ONLY AFTER A SALES REPRESENTATIVE HAS CONFIRMED STOCK BY PHONE.
Promotions and Special Offers
MARLYD unilaterally sets the rules for the promotions & special offers it organises.
These rules are communicated to potential participants only through our website. Promotions apply only to orders that strictly comply with the rules displayed on the website. Furthermore, promotions apply only to orders registered by the company during the period in which the promotion is valid and only while stocks last.
We do not guarantee the stock availability of promotional products, and we may suspend or cancel a promotion at any time without prior notice.
The Seller reserves the right to cancel an order in the event of obvious typographical/technical errors regarding the price or characteristics of the product.
Customer obligations
When using the MARLYD website, you agree to provide true, accurate, current and complete information about yourself, as required in the user registration section, and you agree to provide this information correctly and in full.
If we consider that you are not complying with this obligation, we reserve the right to block your access to the service, for a fixed or indefinite period, without prior notice.
The Customer is solely responsible for the accuracy of the data provided and for any financial, logistical or legal consequences arising from entering incorrect or incomplete data (e.g. late delivery, incorrect invoicing)
If a user account is created, the Customer is responsible for keeping the username and access password confidential. The Customer assumes full responsibility for all activities, orders and transactions carried out through their account. If the Customer suspects unauthorised use of the account or a security breach, they must notify the Seller immediately.
The Customer must update the data in their account or requests whenever changes occur (e.g. delivery address, phone number, company billing details), so that orders or contracts can be carried out properly.
The Customer undertakes to be present at the delivery address indicated, or to appoint an authorised person, to receive the products/services.
Limitation of liability
The companies, products or services mentioned in the published articles are registered trademarks of their respective companies. Any registered brand name is used solely for the purpose of analysis and does not constitute advertising for the company concerned.
We shall not be liable to any person or company that uses or relies on inaccurate information or opinions contained on this website.
Nor shall we be liable for: any damage (direct, indirect, incidental or otherwise) resulting from the use of, or the inability to use, the information presented on the website, or any errors or omissions in the content that may lead to any kind of loss.

If other details or product prices have been displayed incorrectly, including because they were entered incorrectly in the database, www.marlyd.ro reserves the right to cancel delivery of the product concerned and to inform the customer of the error as soon as possible.
The maximum value of the obligations of SC Marlyd Medical Devices SRL towards any customer, in the event of non-delivery or improper delivery, is the value of the amounts collected by MARLYD from that customer for the order in question.
Non-Warranty Statement
The Customer understands and agrees that they use the Site at their own risk. The service is provided “as is” and “as available”, to the maximum extent permitted by law. The Company expressly disclaims any warranty, express or implied, regarding the Site and your use of it, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement of copyright.
The Company accepts no responsibility for any product or service offered by a third party, or advertised, or offered by any website linked to it or featured on any banner or advertising material, and the Company will not be a party to, and will in no way be responsible for monitoring, any transaction between you and third-party providers of products or services.
As with the purchase of any product or service through any means or in any environment, you should use your best judgement and exercise caution where appropriate.
No advice or information, whether oral or written, obtained by you from the Company or through the Site shall create any warranty not expressly stated in this Statement on the terms of service.
Fraud and Disputes
Any attempt to gain unauthorised access to the marlyd.ro website and any attempted fraud will be reported to the competent authorities. Any conflict arising between the company and its customers will first be settled amicably, by agreement between the two parties.
If this is not possible, the relevant Romanian legal provisions will apply and the conflict will fall within the jurisdiction of the Romanian courts.

- The order information is needed to confirm the order and deliver the products ordered, and it is not provided to any third party.
- MARLYD does not sell or provide the e-mail addresses obtained through this website.
- MARLYD reserves the right to occasionally send information about promotional offers, stock clearances and newsletters to the customer’s e-mail address.
